The following General Terms and Conditions (GTC) apply to the sale of goods by Naturaleza GmbH (hereinafter also "Naturaleza", "we" or "Seller") via our online store at www.naturaleza-naturprodukte.ch (hereinafter also "Shop" or "Website") in the version valid at the time of conclusion of the contract. 

1. VERTRAGSSCHLUSS

(1) The presentation of goods on our website is merely a non-binding invitation to visitors to our store to submit a purchase offer to us. Sending the order in the webshop by clicking on the "Buy" button constitutes a binding offer on the part of the visitor to conclude a purchase contract.

(2) We shall confirm receipt of the order immediately by means of an automatically generated email ("confirmation of receipt"). This message does not constitute acceptance of the offer to conclude a purchase contract. An effective purchase contract is only concluded with the receipt of a further e-mail ("shipping confirmation") or by sending the ordered goods.

(3) The contract is concluded with Naturaleza GmbH, Seestrasse 113a, 9326 Horn, Switzerland.

1. PRICES AND PAYMENT

(1) The prices quoted are in CHF including the statutory value added tax plus the indicated shipping costs. The prices stated at the time of ordering apply.

(5) The customer agrees that Naturaleza GmbH grants the partner company CBD MED Schweiz Handels GmbH, the third parties involved for the credit assessment of the customer and for the collection of the purchase price (in particular CRIF AG, Zurich, or a company affiliated with it) access to his personal data originating from the business relationship at any time, including all payment experiences from the order process. The customer is entitled to revoke the above consent in writing at any time.

1. LIEFERUNG

(1) The delivery of goods shall be made by dispatch to the delivery address specified by the Buyer. In exceptional cases, delivery bottlenecks or other unforeseeable circumstances may result in longer delivery times than those stated. In particular, we have no influence on delivery delays caused by the shipping company. For orders from abroad, delivery may be delayed accordingly.

(1) Naturaleza gives the customer the opportunity to register and open a customer account by clicking on the "Register" button. Registration is purely voluntary in order to simplify future orders. Registration is not mandatory in order to place orders.

(2) The customer is obliged to treat his personal access data confidentially and not to make it accessible to unauthorized third parties.

(3) Registration with Naturaleza GmbH is free of charge. There is no entitlement to registration. We can also link the registration to other requirements (e.g.B. Checking the login data). The customer is obliged to provide correct and accurate information when registering. Changes to the data should be communicated by the customer to avoid costs if he wishes to place a new order. In particular, the customer must provide his full name, address and e-mail address. Naturaleza is entitled to effectively send declarations to be made to the customer to the customer's e-mail address, unless a stricter form is prescribed by law or agreement.

(4) The personal data stored during registration will be saved by us so that the customer can log in again at any time using their access data. (5) A minimum age of 18 years is required for registration and ordering on our website. You must confirm that you are at least 18 years old.

1. WIDERRUFSRECHT

Consumers have a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

CONSEQUENCES OF WITHDRAWAL:

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. (3) Attention: If you have ordered one of our tinctures please note that the oil may leak if oil gets into the thread during transportation. We therefore recommend that you do not transport the oil.

(4) The above limitations of liability also apply in favor of the legal representatives and vicarious agents of the seller.

(5) The above limitations of liability shall not apply if the seller has fraudulently concealed a defect or has assumed a guarantee for the quality of the goods. The same applies to claims of the buyer under the Product Liability Act.

(1) The buyer expressly agrees that communication between him and Naturaleza may take place electronically, in particular via unencrypted e-mail. The buyer is aware that unencrypted e-mails only offer limited security and confidentiality.

(2) The buyer must ensure that the e-mail address provided by him for order processing is correct so that the e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.
